Spike Labs, Inc., d/b/a Luv.ai (“Luv,” “we,” “our,” or “us”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and retain information when you access our website, mobile applications, or any other service that links to it (collectively, the “Services”). Your use of the Services is also governed by our Terms of Service.

We use the information described above to:

Operate, maintain, and improve the Services and our AI models (including training, fine-tuning, evaluation, and safety testing).
Provide personalized experiences – generate companion responses, remember your preferences, and recommend content.

Monitor trust & safety – detect policy violations, moderate content (which may involve automated filters or human reviewers, including vendors outside the U.S.), and prevent fraud.

Comply with legal obligations, enforce our Terms of Service, and protect the rights, safety, and property of Luv, our users, and others.

We do not sell your personal information. We may disclose it as follows:

5. Your Rights & Choices

Delete my data	Deleting your account removes or anonymizes your personal data within 30 days, subject to legal retention requirements. Back-ups are purged on the same schedule.
Marketing preferences	Opt out of promotional emails via the unsubscribe link. Transactional messages will still be sent.
Do-Not-Track / cookie controls	Adjust browser or mobile-OS privacy settings.
Region-specific rights	• EU/UK – access, rectification, erasure, restriction, objection, and data portability (Art. 15-20 GDPR).• California – know, delete, correct, and opt-out of “sharing” for cross-context behavioral advertising (CCPA/CPRA). Submit requests by emailing support@luv.ai. We will verify your identity before processing.

6. Legal Bases for EU/UK Users

We process personal data only when we have a lawful basis:

Contractual necessity – to provide the Services you request.
Legitimate interests – to secure and improve the Services, prevent misuse, and conduct research (balanced against your privacy).
Consent – for optional features such as marketing emails or certain cookies.
Legal obligation – to comply with applicable law.

You may withdraw consent at any time without affecting the lawfulness of prior processing.

We are headquartered in the United States. When we transfer personal data from the EU/UK or other regions with data-transfer restrictions, we rely on recognized safeguards such as Standard Contractual Clauses (SCCs) or an adequacy decision.

Deleted-account data and back-ups are permanently erased or de-identified within 30 days, unless longer retention is required by law.

10. Children’s Privacy

Luv.ai is restricted to users 18 years and older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided personal information, contact us at support@luv.ai and we will promptly delete it.

11. Changes to This Privacy Policy

We may update this Policy from time to time. If we make material changes, we will notify you by email or in-app notice and post the revised Policy with a new “Last Updated” date. Continued use of the Services after the update constitutes acceptance.
